POLICY AND PROCEDURE MANUAL

AGENCY PLAN FOR CLIENT RIGHTS


POLICY:

As a recipient of the Tony Rice Center, Inc. services, you are entitled to certain rights that are extended to you either by the law or agency policy.


PROCEDURE:

Recipients of Tony Rice Center, Inc. Services are extended the following rights:

1. Upon admission, Clients will be advised of their rights as a Client of the Tony Rice Center, and at completion of the review of said rights, the Client will be asked to acknowledge his or her understanding by his or her signature, and then a copy will be included in his or her personal file.

2. To access treatment that is impartial and without discrimination by race, religion, ethnicity, sexual orientation, or the ability to pay.

3. To comprehend the rules & regulations of Tony Rice Center.

4. To individualized treatment, include adequate and humane services, regardless of source of financial support.

5. To know the Clinical Staff responsible for your care, their professional background, and relationship to other Staff Members employed by the organization.

6. To treatment in the least restrictive environment, in a setting that provides privacy within the limits of your treatment plan.

7. To actively participate in your treatment planning, including periodic review of your treatment plan.

8. To visitation by all concerned persons that have been clinically determined to be the utmost benefit to your treatment in accordance with Tony Rice Center’s policies.

9. To a suitable area in which to receive visitors.

10. Since participation in the Tony Rice Center, Inc. Services is on a voluntary basis, you have the right to refuse any specific medication or treatment procedure. If your refusal compromises what is believed to be beneficial treatment for your case, Tony Rice Center may refuse services to you and may refer you to another agency.

11. To know that Tony Rice Center has certain responsibilities in your treatment. One of which is that if you refuse recommended treatment and the Clinical Staff determines you are a clear danger to yourself or others, we are obligated to seek legal alternatives or orders for involuntary treatment.

12. To the receiving and sending of mail without hindrance.

13. To complain or initiate a grievance without fear of reprisal, as described by the grievance procedure.

14. To conduct private telephone conversations unless contradicted by Clinical considerations.

15. To request an ethics review/investigation of any staff member without fear of reprisal.

16. To know the nature of the care, procedure, and treatment you receive.

17. To request the opinion of a consultant at personal expense or to request an in-house review of the individual treatment plan.

18. To know that identifiable photographs, video tapes, films, cellphone recordings, etc. will not be made or used without your written or signed consent, nor will you be required to make public statements which acknowledge gratitude to Tony Rice Center, Inc. for its services.

19. To be informed of all risks and side effects of all medications and treatment procedures used.

20. To request and receive information regarding alternative programs, method(s) of treatment, and the availability of outside consultation from another treatment professional.

21. To notification in advance before any group or individual tours the facility

22. To know the cost of services you are receiving.

23. To request a change in your Primary Counselor or Physician.

24. To know of proposed changes to Clinical Staff responsible for your care and to be informed of any transfer within Tony Rice Center to another program.

25. To participate in planning for your treatment and discharge.

26. To confidentiality—Confidentiality about your treatment is assured by Federal Regulations as published in the Federal Register, Volume 40, Number 127, Title 42, Public Health Regulations, Part 2: Confidentiality of Alcohol & Drug Abuse Patient Records, and later amendments. You have already signed a release of information when you were admitted which was necessary for Clinical Staff to release information necessary for offering you the full range of treatment procedures. No other information will be requested or released without again obtaining your written permission. We will acknowledge your presence only to those for whom we have obtained a written release.


LIMITATIONS TO CLIENT RIGHTS

If Clinical Staff determines that you are a clear and immediate threat or danger to yourself or others, we are obligated to notify the appropriate agency or individuals in order to maintain adequate safety for all involved. This threat of danger overrides your right to confidentiality. Along with the threat of harm to yourself or others, confidentiality does not apply to child abuse, medical emergencies, or a court order.

Because reintegration into the community is one of the goals of treatment and because this involves your ability to participate in community and social activities without resorting to alcohol and/or drug use, you do not have the right to refuse to participate in community outings that are designed to teach you how to use leisure time constructively. Requests to be excluded from participation in a particular event will be considered on an individual basis and determination will be based on the clinical needs of the Client.


EQUAL OPPORTUNITY IS THE LAW IN TENNESSEE

The Civil Rights Act of 1964 was passed to ensure the people of the United States received equal treatment, rights, and opportunities regardless of race, color, or national origin. Title VI of that Act prohibits discrimination in federally funded programs


“No person in the United States shall, on the basis of race, color or national origin, be excluded from participation in, be denied the benefits of or be subjected to discrimination under any program or activity receiving Federal Financial Assistance.”


Included under National Origin is discrimination based on a person’s inability to speak, read, write, or understand English. Persons whose primary language is not English can be Limited English Proficient or “LEP.” These individuals may be entitled to language assistance with respect to a particular type of service, benefit, or encounter.


All programs and operations of entities that receive assistance from the federal government must comply.

It is important that all applicants and service recipients know about their rights under the law, and that employees of Tony Rice Center as well as other agencies, organizations, institutions, and contractors providing services with state support understand what the law requires.


Any person who applies for or receives any benefit or services by Tony Rice Center may file a complaint if or she has had unfair or different treatment because of race, color, or national origin.

Complaints must be filed in writing with the Title VI representative of the location of the alleged discrimination. Tony Rice Center. Or with the appropriate regional or central office at the Department of Mental Health and Substance Abuse Services; or with the Office of Civil Rights, 101 Marietta Tower, Suite 2706. Atlanta, Georgia 30323


Tony Rice Center does not, because of race, color, or national origin:

1. Deny an individual any services, opportunity, or other benefit for which he or she is otherwise qualified.

2. Provide any individual with any service, or other benefit, which is different or is provided in a different manner from that which is provided to others under the program.

3. Subject any individual to segregation or separate treatment in any manner related to his or her receiving of service(s).

4. Restrict an individual in any way in the employment of services, facilities or any other advantage, privilege or other advantage, privilege or other benefit provided to others under the program.

5. Adopt methods of administration which would limit participation by any group of recipients or subject them to discrimination.

6. Address an individual in a manner that denotes inferiority because of race, color, or national origin.
